OHIO WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNIFICATION AGREEMENT

Facility: Al-Omary Gym

By signing up as a member, the Participant (named on the account) agrees to the following terms.

1. ACKNOWLEDGMENT OF INHERENT RISKS

I acknowledge that participation in fitness activities and the use of exercise equipment involve inherent and significant risks of injury, including but not limited to muscle strains, sprains, fractures, cardiac events, permanent disability, and death. These risks may arise from my own actions or inactions, the actions or inactions of others, the condition of the premises, or the use or misuse of equipment.

2. ASSUMPTION OF RISK

I voluntarily and knowingly assume all risks, known and unknown, associated with my use of the facility, equipment, and participation in any programs, whether supervised or unsupervised. I accept full responsibility for any injury, loss, or damage that I may sustain.

3. RELEASE AND WAIVER OF LIABILITY (INCLUDING NEGLIGENCE)

TO THE FULLEST EXTENT PERMITTED UNDER OHIO LAW, I HEREBY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE THE FACILITY, ITS OWNERS, OFFICERS, EMPLOYEES, TRAINERS, CONTRACTORS, AGENTS, AND AFFILIATES (COLLECTIVELY, THE "RELEASED PARTIES") FROM ANY AND ALL CLAIMS, DEMANDS, DAMAGES, LOSSES, OR CAUSES OF ACTION ARISING OUT OF OR RELATED TO ANY INJURY, ILLNESS, DEATH, OR PROPERTY DAMAGE THAT MAY OCCUR WHILE I AM USING THE FACILITY OR ITS EQUIPMENT, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES OR OTHERWISE.

THIS RELEASE EXPRESSLY INCLUDES CLAIMS BASED ON ORDINARY NEGLIGENCE.

4. INDEMNIFICATION AND HOLD HARMLESS

I agree to indemnify, defend, and hold harmless the Released Parties from any and all claims, liabilities, damages, costs, and expenses (including attorney's fees) arising out of or related to my use of the facility, my actions or omissions, or my violation of any facility rules.

5. HEALTH AND MEDICAL REPRESENTATION

I represent that I am in good physical condition and have no medical condition that would prevent safe participation in physical exercise. I acknowledge that I have been advised to consult with a physician prior to engaging in any fitness program. I assume all responsibility for my health and participation.

6. RULES, INSTRUCTIONS, AND EQUIPMENT USE

I agree to follow all facility rules, posted warnings, and staff instructions. I understand that improper use of equipment increases the risk of injury, and I accept full responsibility for learning and using equipment safely.

7. WAIVER OF JURY TRIAL

TO THE FULLEST EXTENT PERMITTED BY LAW, I HEREBY WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY ACTION OR PROCEEDING ARISING OUT OF OR RELATED TO THIS AGREEMENT OR MY USE OF THE FACILITY.

8. GOVERNING LAW AND VENUE

This Agreement shall be governed by and construed in accordance with the laws of the State of Ohio. Any legal action shall be brought exclusively in a court of competent jurisdiction located within the State of Ohio.

9. SEVERABILITY

If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

10. ACKNOWLEDGMENT OF UNDERSTANDING

I HAVE READ THIS AGREEMENT CAREFULLY AND FULLY UNDERSTAND ITS TERMS. I UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE FOR NEGLIGENCE. I ACKNOWLEDGE THAT I AM SIGNING THIS AGREEMENT FREELY AND VOLUNTARILY.

Participant identity, date of birth, address, and emergency contact are provided during account signup. By checking the "I have read and agree to the liability waiver and terms" box during signup, I am providing my electronic signature to this Agreement as of the timestamp recorded on my Waiver Acceptance record.

For members aged 13-15, the parent or guardian named at signup is required to consent to this Agreement on the Participant's behalf, and that consent is recorded with the member's account.
